Employment law in Luxembourg

This brochure aims to give an overview of Luxembourg labour law as laid down in the Labour Code.

Today, most of Luxembourg labour law is included in the Labour Code, applicable to employees under private law contracts.

It is important to stress that the Labour Code defines the rights and responsibilities existing in the employer-employee relationship by establishing a set of minimum rights and responsibilities. As a result, the employment contract may set out additional conditions that are more favorable to the employee, but it cannot establish exceptions to the minimum statutory requirements that would be disadvantageous to the employee. Consequently, any clause contrary to the provisions of the Labour Code that restricts the rights or increases the obligations of the employee shall be considered as void.
